Introduction

1. Peaceful demonstrations are a catalyst for the advancement of human rights. Yet around the world governments are criminalizing dissent and suppressing public #protest, often as a means to protect #CorporateInterests. In this context, indigenous peoples increasingly find themselves as the subjects of arrests, criminal prosecution and police violence when defending the lands they rely upon for their existence and survival from #ResourceExtraction by industries who are operating without the free prior and informed consent of the affected communities.

2. This report is submitted to the Inter-American Commission on Human Rights (#IACHR) in conjunction with a thematic hearing held during the 172nd period of sessions. At the hearing,
Commissioners heard directly from those involved in the indigenous-led resistance to the #DakotaAccessPipeline (DAPL) at Standing Rock, North Dakota. This report addresses the criminalization and suppression of protest by indigenous human rights defenders and their allies by United States (U.S.) federal, state and local governments, working hand-in-hand with private security forces [#Blackwater], specifically in relation to the construction and operation of #DAPL by #EnergyTransfer
Partners and Dakota Access, LLC (Dakota Access) and the connected #BayouBridgePipeline (collectively the “#BakkenPipeline”).

3. Standing Rock is an emblematic case of #IndigenousResistance to extractive industry that drew attention from around the world as water protectors met on the banks of the #MissouriRiver in peaceful assembly in what was the largest gathering of indigenous peoples in the U.S. in 100 years. Standing Rock is merely one example of how the U.S. government works with industry to approve energy projects carried out without the meaningful participation or consent of
indigenous nations. Indigenous peoples are left with no choice but to peacefully protest and then are criminalized for their efforts to defend their lands and resources.

4. Since Standing Rock, there has been an alarming trend by the United States government and state legislatures to criminalize opposition to pipelines and other energy projects. These #AntiProtest and so-called “#CriticalInfrastructure laws” progress towards criminalizing dissent and implicitly condone the use of excessive force towards human rights defenders, often including indigenous peoples and their allies who are at the forefront of resistance to extractive industries. As the international community has acknowledged, these laws are incompatible with domestic and international law. The governments’ use of excessive force and mass arrests to threaten, intimidate, and silence “#WaterProtectors” seeking to defend their lands, resources, and #culture, and the collusion with private security forces, violate fundamental human rights to #FreeSpeech and Aassembly enshrined in international human rights law and the #USConstitution.

5. The information provided here builds on a 2016 request for Precautionary Measures filed by the #StandingRock, #CheyenneRiver and #YanktonSioux tribes, past Commission hearings on similar matters that remain unsettled, and reports on Indigenous Peoples and Extractive Activities, and the Criminalization of #HumanRightsDefenders. In addition, the United Nations has reported on the situation at #StandingRock through the Expert Mechanism on the Rights of of indigenous peoples. Despite condemnation from these international bodies and mechanisms, water protectors continue to suffer impacts from the criminalization of their dissent, while the United States moves forward permitting new #pipeline projects on indigenous territories.

"The #StandingRockLakotaNation has filed a new fedral lawsuit against the Army Corps of Engineers in Washington describing its threat to the water, and how Energy Transfer bulldozed the burial places of their elite warrior society. The Standing Rock Sioux Tribe demands the immediate shut down of the pipeline.

"In a separate lawsuit in #NorthDakota state court, #EnergyTransfer is carrying out a fishing expedition, serving media and #WaterProtectors with third party subpoenas for the case slated in court for February 2025.

"In this case, the pipeline company is suing #Greenpeace and #RedWarriorSociety, and two Red Warrior #WaterProtectors. Greenpeace refers to the lawsuit as a frivolous $300 million #SLAPP lawsuit.

"Greenpeace now has a new report on the pipeline's #Environmental Rsks, and the threat to the water of millions of people who live along the #MissouriRiver. The new report strengthens Standing Rock's new lawsuit."

" #PeacefulProtest and #FreeSpeech are fundamental human rights that underpin social progress. The Energy Transfer $300 million lawsuit against Greenpeace is an abuse of the legal system and a blatant attempt to silence legitimate work to protect people and our planet.

"This lawsuit makes allegations that affect people far beyond Greenpeace. It attempts to rewrite the history of the #Indigenous-led opposition movement at #StandingRock – by absurdly alleging that Greenpeace orchestrated the entire resistance.

"It seeks to hold the Greenpeace organizations in the US and Greenpeace International accountable for actions taken by unaffiliated and unknown individuals. This could have a chilling effect on anyone engaged in peaceful protest and assembly. It also attempts to sue over justified and protected speech, claiming it is '#defamation.' This is #corporate overreach that is part of a disturbing trend of attacks on advocacy and speech around the world.

"We will not allow lawsuits like this one to stop us from advocating for a just, green and peaceful future. On the contrary, we will ensure they have the opposite effect, increasing the support for organizations like Greenpeace and strengthening the broader movement for justice.

"This legal attack on Greenpeace is an attack on us all. We will not stand idly by. We will not be bullied. We will not be divided and we will not be silenced.

STANDING ROCK, #NorthDakota -- "Energy Transfer's $300 million #SLAPP lawsuit against Greenpeace and Standing Rock #WaterProtectors for the resistance to #DakotaAccessPipeline has been delayed until February, due to a 'massive document dump' by Energy Transfer, Greenpeace told Censored News today.

"Originally, our trial was set for July 29th, 2024 – but due to a massive document dump by Energy Transfer in June, Greenpeace filed a request to have the trial date pushed back. The judge agreed, and moved our trial to February 24, 2025 through March 28, 2025," Lindsay Bigda, communication director, Democracy Resilience Program at Greenpeace USA told Censored News today.
Responding to questions, Greenpeace said #RedWarriorSociety and other water protectors are named in the lawsuit.

"'Red Warrior Society is still named in the lawsuit and last week our lawyers presented arguments for why it shouldn’t be (because it is not the sort of entity that can be sued). The two individuals, #CodyHall and #KrystalTwoBulls, are also still named, but were never served. (Greenpeace entities are the only ones that were served and are actively litigating),' Bigda told Censored News.

"'Very few jurisdictions have made steps to prevent the corporate legal warfare waged in SLAPPs to #SilenceDissent and freedom of expression. The United States has long failed to uphold #HumanRights and #Indigenous leaders have had no choice but to leave their precious homelands; and use international diplomacy to implore all those who will listen for an end to the #extractive industry violence.'

"'Europe played a key role in the #colonization of the planet. Now let's see if she, her people, and jurisdictions, can help in undoing and healing that historic wound. #IndigenousPeoples must continue to engage with Europe to seek justice and #corporate accountability.'

"Standing Rock water protectors have been served subpoenas in the case from Energy Transfer, as it seeks out information. #UnicornRiot fought the subpoena in #Minnesota and won its case to protect its internal media files. However, Energy Transfer has now asked the Minnesota Supreme Court to reconsider its case.

"Greenpeace clarified the reason for the subpoenas that water protectors and Unicorn Riot media were served with.
'Unicorn riot was never named in the lawsuit. They received a third party subpoena, along with many other activist groups and individuals (these folks are not parties to the case; rather, they are third parties that Energy Transfer wants info from in its case against Greenpeace,)' Bigda told Censored News.

"Mercenaries #TigerSwan Spied without a License, Provided Info to Law Enforcement

"Red Warrior Camp was a focus of the mercenaries hired by Energy Transfer at Standing Rock in September of 2016, as revealed in the court-ordered spy documents released.
TigerSwan was found working in North Dakota without a license from 2016 through 2017. As a result, the North Dakota regulatory board ordered that TigerSwan's spy files be released. The Intercept now has over 50,000 of TigerSwan's spy documents at Standing Rock, as a result of a lengthy court battle. Energy Transfer, employer of TigerSwan, fought the release of documents in North Dakota court, but the North Dakota Supreme Court upheld the decision to release TigerSwan's documents in 2022.

"The TigerSwan aerial photos included #OcetiSakowin Camp, Red Warrior Camp, and the other camps. The spy documents reveal that a U.S. Border Patrol drone was included in the aerial #surveillance and #infiltrators were placed in the water protector camps at Standing Rock and elsewhere.

"Meanwhile, after Standing Rock, TigerSwan's CEO formed a new company. Syria says they are stealing #Syria's oil. CNN reported about the secretive contract and the new company.

#Palestinians Targeted for Surveillance by TigerSwan at Standing Rock

"As soon as a single #Palestinian activist showed up at an anti-Dakota Access Pipeline camp on the edge of the Standing Rock reservation in 2016, intelligence analysts for the mercenary security firm TigerSwan were on alert," by Alleen Brown, Drilled and co-published with the Center for Media and Democracy."
